Plaintiff city of Traverse City, a municipal corporation, on May 24, 1952, filed a bill of complaint seeking injunctive relief against defendant Consumers Power Company, a Maine corporation. The city also sought a declaration of rights regarding the franchise it had granted to defendant's predecessor, the Boardman River Electric Light & Power Company, with respect to the nature and extent of the rights or privileges of Consumers to extend its power facilities within the corporate limits of Traverse City.
