Patrick Schantzen was convicted in the court of the police Justice of the peace for the city of South Milwaukee of a violation of the city ordinance against drunken driving. He appealed to the circuit court and there was found guilty and judgment was entered February 6, 1950, adjudging that the plaintiff city recover from him a fine and costs and in default of payment, the defendant be imprisoned in the House of Correction. The proceedings were commenced on July 8, 1949, when a city policeman filed with the police Justice of the peace an affidavit of which the material part follows:
