In this proceeding the city of St. Francis petitioned to review the determination by the Public Service Commission of the
value of the water utility of the town of Lake. As a result of proceedings initiated by electors residing in a district of
the town of Lake, a certificate was issued on July 25, 1951, incorporating said district as the city of St. Francis. Statutory
proceedings were taken to adjust the assets and liabilities of the town of Lake between the two municipalities. The major portion of the patrons of said water utility resided in the territory remaining in the town of Lake. When the two
municipalities could not agree upon the value of such utility, a request was made to the Public Service Commission to determine
such value. The commission, after investigation and hearing, determined the value of said utility to be $888,086.03, subject
to bonded indebtedness and other liabilities of $681,816.26, leaving a net value of $206,269.77. The circuit court for Dane
county, upon proceedings to review said determination, held that it had jurisdiction to review such determination of the Public
Service Commission under the provisions of ch. 227, Stats., and affirmed such determination. Judgment was entered on October
27, 1954, and the city of St. Francis appealed therefrom. The Public Service Commission moved for review of that part of the
judgment holding that the court had jurisdiction to review the determination of the commission.
